1.-Owner and general conditions of sale

These General Contracting Conditions regulate the purchase conditions of the different products offered on the website https://topmanta.store/andedem/ owned by the Popular Cooperative of Street Vendors of Barcelona, SCCL, with NIF F67528067 and registered office at Barcelona, Spain (Postal Code: 08001), Carrer d'En Roig nº 13, bajos.

Users who make purchases at https://topmanta.store/andedem/ fully accept these Conditions and will be bound by them as they were written at the time of contracting. The reading and acceptance of the Conditions will be an essential requirement prior to the purchase of any product through https://topmanta.store/andedem/

The Conditions will always be accessible from the website, so that the user can consult them at any time.

2.- Purchase procedure

The purchase process is very simple, whether it is the first time you buy at https://topmanta.store/andedem/or if you have already bought before, since no prior registration is required:

1) Choose the desired product, and you will see a detailed description of it and its price. At this time, you will be informed of the availability of the product.

Top Manta joins the ethical and sustainable production model, so we only produce what is going to be used without generating unnecessary surpluses. Hence, we offer a limited first edition of 400 pieces. If at the time of purchase the size and/or model that you want is out of stock, you can register and we will inform you when we will produce the second edition and your size and/or model will be available.

2) Once the availability of the product is confirmed, the next step will be to confirm the reservation, indicate the shipping address and make the payment. Payment can be made by card or via PayPal.

At the end of the payment, an email confirming the purchase will be sent, specifying all the details of the order, as well as the indicated shipping address. If you observe an error in the indicated address or in any other point of the order, you must notify it immediately by writing to the email [email protected] to proceed to correct the error.

3.- Shipping costs and delivery of the order

3.1. Shipping costs

During the purchase procedure, you must indicate the shipping address of the order, and then the corresponding shipping costs will be indicated, depending on the country:

 PAQ STANDARD - Spain and Portugal (Home delivery in 48-72h)

PAQ LIGHT INTERNACIONAL (Mailbox delivery - delivery times according to country)

Near Europe: Germany, Austria, Belgium, Denmark, France, Gibraltar, Greece, Ireland, Italy, Jersey Island, Luxembourg, Norway, Netherlands, Portugal, United Kingdom, Sweden, Switzerland.

ZONE B - € 30

European countries not included in Zone A, North Maghreb and Turkey: Cyprus, Croatia, Slovakia, Slovenia, Estonia, Russian Federation, Finland, Hungary, Iceland, Latvia, Lithuania, Malta, Poland, Czech Republic, Serbia and Turkey.

ZONE C - € 30

America: Aruba, Barbados, Brazil, Canada, Mexico, Dominican Republic.

ZONE D - € 30

Asia, Middle East and Oceania: Saudi Arabia, Australia, South Korea, Georgia, Hong Kong, Indonesia, Israel, Japan, Lebanon, Malaysia, New Zealand, Singapore and Thailand.

ZONE E - € 30

Rest of Africa: Egypt, South Africa and Swaziland.

 3.2. Delivery times

Unless extraordinary circumstances occur, we will try to manage the shipment of the product/s order within 48 hours after the "reservation confirmation".

Once the shipment has been managed, the delivery will be made to the indicated address, within the following 48-72 hours, if the shipment is in Spain or Portugal. If the shipment is made in another country, the delivery will be made in the Mailbox, and the delivery time may vary depending on the corresponding country.

The delay, if any, may be due to unforeseen circumstances or the delivery area.

For the purposes of these Conditions, it will be understood that the "delivery" has occurred or that the product/s have been "delivered" at the time of signing the receipt of the same at the agreed delivery address.

4.- Product availability

Top Manta joins the ethical and sustainable production model, so we only produce what is going to be used without generating unnecessary surpluses. If at the time of purchase the size and/or model that you want is out of stock, you can register and we will inform you when we will produce the second edition and your size and/or model will be available.

5.- Guarantee

All products offered at https://topmanta.store/andedem/ have a guarantee as established in current legislation. The warranty will not cover any damage or damage caused by misuse, improper handling or those derived from the ordinary use of the object.

6.- Returns and exchanges; right of withdrawal

6.1. Returns of defective or damaged products

In the case of defective or damaged products at the time of delivery, you must contact us immediately at the email address [email protected]e, providing the order number or the reservation confirmation email, and we will inform you how to proceed.

Notwithstanding the above, we want to remind you that Ande Dem sneakers have been produced in small handcrafted shoe workshops and sewn manually. Thus, the products may contain slight imperfections inherent to the manufacturing technique itself, which in no case will be considered as defects.

The amounts paid for those products that are returned due to any defect or defect, when it really exists, will be reimbursed, including the delivery costs incurred to deliver the item, as well as the expenses generated by the return of the defective product. The refund will be made through the same means of payment that was used to pay for the purchase.

Product returns will not be accepted in the following cases:

  • the product is in poor condition
  • the product is not complete, accessories are missing or it is tampered with and/or broken.
  • missing accessories or instructions or any other documentation
  • slight imperfections inherent to the product's own manufacturing technique
  • the period established for this purpose has elapsed 

The reimbursement of the amounts paid will be made once we receive the product and verify that it is in perfect condition (except in cases of defective or damaged products during the transport of delivery to the client) and never in a period exceeding 14 calendar days

6.2. Size changes

We inform you that we do not make size exchanges. If at the moment of delivery you think that the product does not match with the confirmed reservation, you may return it and we will refund the amount you paid for it, but you will have to buy a new product .

To do this, you must communicate it to the email address [email protected], within a period of 14 calendar days from the receipt of the order, and send the product to our store - located at Carrer d'En Roig, 13, Postal Code 08001, Barcelona (Spain) - either personally or by courier.

Once we receive the product and verify that it is in perfect condition, we will reimburse you for all payments that we have received from you, including delivery costs where applicable, but the return transport costs will be paid by the buyer. The refund of the amounts paid will be made through the same means of payment that was used to pay for the purchase, and no later than 14 calendar days from the date of your communication. 

After this period, no change or refund will be accepted.

6.3. Withdrawal

In addition, we inform you that you legally have the right to withdraw from the contract. You can do it during a period of 14 calendar days from the receipt of the order, without indicating the reason and without incurring any cost other than the return costs, which are the consumer's account.

To do this, you must communicate it to the email address [email protected], within that period. We remind you that the burden of proof of the exercise of the right of withdrawal falls on the consumer and user.

The costs of the return transport will be borne by the buyer, except in the case that the product is defective, or has arrived in poor condition due to damage suffered during transport.

You can return the product directly to our physical store - located at Carrer d'En Roig, 13, Postal Code 08001, Barcelona (Spain), from 10:00 to 21:00 from Monday to Saturday - which will not involve any cost. You can also do it through any postal or courier service, the cost of which will vary depending on the place from which you send it, the weight of the package and the service you choose to return it. As it is a cost that the customer assumes, he is free to choose the means of return. We are not responsible in any case for the variation that the rates of the courier companies may suffer, or for the successful completion of the shipment.

In the event of withdrawal, we will refund all payments we have received from you, including delivery costs where applicable, without any undue delay and, in any case, no later than 14 calendar days from the date on which inform us of your decision to withdraw from the contract. However, the refund may be withheld until the products have been received, or until you have presented proof of their return, depending on which condition is met first.

After this period has elapsed without having communicated the will to withdraw, no change or refund will be accepted.

Instructions for the return in case of withdrawal

You can return the products to us by post, courier service or in our physical store. The cost of shipping is borne by the buyer. Keep in mind that if you decide to return the items to us postage due, we will be authorized to reject said return, or deduct the costs generated by this shipment from the total refund.

Please, bear in mind that to accept the return it is essential to send the item including its original packaging as well as the instructions, documentation and packaging that may accompany it.

After examining the product, we will inform you if you are entitled to a refund of the amounts paid. The refund will be made as soon as possible and, in any case, within a period of 14 calendar days from the date you have been informed of your withdrawal decision, provided that the product has been received at our facilities within the legally established period. The refund will always be made through the same means of payment that was used to pay for the purchase.

When making the return, you must bear in mind that we will carefully examine the product to check if there is deterioration or dirt on the sole, damage due to improper use, fading, residues such as balls or fluff (whether from socks or animals) or any damage caused by external causes, in which case the customer will be responsible for the depreciation that the product may have suffered. The same will happen if the original box is damaged (if it has been written on, taped or its label tampered with).

 7.- Events beyond our control

We will not be responsible for any breach or delay in the fulfillment of any of the obligations that we assume under a Contract, the cause of which is due to events that are beyond our reasonable control ("Force Majeure Cause").

Force Majeure Cause will include any act, event, lack of exercise, omission or accident that is beyond our reasonable control, and will include in particular (without limitation) the following:

  • Strikes, lockouts or other industrial action.
  • Civil commotion, revolt, terrorist attack or terrorist threat, street disturbances, protests and socio-political demands, war (whether declared or not) or threat or preparations for war.
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.
  • Impossibility of using trains, boats, airplanes, motor transport or other means of transport, public or private.
  • Inability to use public or private telecommunication systems.
  • Acts, decrees, legislation, regulations or restrictions of other governments.
  • Strike, failures or accidents of maritime or river transport, postal or any other type of transport.

It will be understood that our obligation to comply by virtue of any Contract will be suspended during the period in which the Force Majeure Cause continues, and we will have an extension in the term to fulfill our obligation for the duration of such period. We will use all reasonable means to end the Force Majeure Cause or to find a solution by which we can fulfill our obligations under the Contract despite the Force Majeure Cause.

 8.- Jurisdiction

These Conditions are governed by Spanish law.

To resolve any controversy or conflict derived from the purchase of products athttps://topmanta.store/andedem/, the parties agree to submit to the courts or tribunals of Barcelona (Spain), both parties renouncing any jurisdiction or jurisdiction to which they may be entitled , except imperative jurisdiction in the case of consumers and users, in which case the competent jurisdiction will be the one corresponding to their domicile.
